Terms of Service
Effective date: October 23, 2026
1. Agreement and scope
These Terms of Service ("Terms") govern the website, educational programs, Pastel Workshop Studio ("Studio"), Folistry, and related services offered by Pastel Workshop ("we," "us," or "our") through pastelworkshop.com and our related program activities (the "Services").
By affirmatively accepting these Terms when creating an account, enrolling, or purchasing, you agree to them. If you do not agree, do not create an account, enroll, or purchase. Our Privacy Policy explains information practices; accepting these Terms does not replace any separate privacy or recording consent required by law.
Specific program, purchase, or guarantee terms disclosed and accepted for your enrollment supplement these Terms and control for their subject if there is a conflict. Mandatory consumer rights remain unaffected. Purchases and participation through Skool are also subject to applicable Skool terms for that platform.

2. Eligibility and accounts
You must be at least 18 and legally able to enter into this agreement to create an account or purchase the Services. Provide accurate account information, keep it current, and protect your credentials. Accounts are for the registered user unless a plan expressly permits additional users. Do not share paid access or impersonate someone else. Notify us promptly of suspected unauthorized access. You are responsible for activity you authorize through your account, subject to applicable law.
3. Programs, products, and included access
| Offering | Purchase channel and included access |
|---|---|
| Pastel Workshop Free and Standard | Educational membership through Skool, with the benefits identified on the selected plan page. |
| Pastel Workshop VIP | Educational membership through Skool, including VIP access to Studio while the membership entitlement is active. |
| Pastel Workshop Master Class | A six-month educational program purchased through pastelworkshop.com, including Master Class access to Studio and Folistry Premium for the six-month term. |
| Folistry Free, Standard, and Premium | Separate artwork management plans offered through pastelworkshop.com. Paid subscriptions are purchased on that domain. Optional AI title and description suggestions are available with Standard and Premium. |
Features, prices, submission limits, coaching schedules, critique availability, and other plan-specific benefits are described before enrollment. One service does not include another unless expressly stated. Free plans do not include paid benefits unless stated.
Studio supports painting and assignment submissions, assessments, critiques, progress records, announcements, and calendar events. Folistry helps organize artwork and related records and offers user-controlled portfolio visibility. We do not promise unlimited or immediate mentor access; the scope and schedule of personal services are those described for your program.
4. Subscription billing and renewal
Ordinary paid subscriptions are billed monthly or yearly according to the option you select at signup. They renew automatically at the disclosed interval until cancelled. The checkout identifies the price, currency, applicable taxes, billing interval, and cancellation method before you subscribe. You authorize the charges you expressly approve, and we obtain required consent and provide required confirmations and renewal notices.
Payments made through pastelworkshop.com are processed by Stripe. Payment card information is not stored on the website. Skool handles the purchase process for memberships sold through Skool.
Master Class is a fixed six-month program. These ordinary subscription renewal rules do not by themselves authorize Master Class renewal or extend your six-month commitment. Any payment schedule, total program fee, and expressly agreed renewal arrangement must be disclosed in your enrollment terms. Included Folistry Premium access does not automatically become a paid Folistry subscription at the end of Master Class; you must choose and authorize a paid subscription.
Any trial, promotion, minimum commitment, or installment arrangement must be disclosed before purchase. A payment schedule for a fixed program is not necessarily a cancellable monthly subscription.
Price increases apply prospectively and will be communicated before the affected renewal with sufficient notice for you to cancel, and with any additional consent required by law. No increase changes an already prepaid period. If a payment fails, we may request updated details and suspend paid access after appropriate notice and an opportunity to resolve it, except where urgent fraud or security concerns require immediate action.
5. Cancellation of Skool memberships and Studio access
Manage and cancel paid Skool educational memberships through your Skool account settings. Cancellation stops future renewals according to the applicable purchase terms. Contact support@pastelworkshop.com if you need help. Access through the remainder of a paid Skool period and any Skool purchase refund terms are those disclosed at purchase, subject to applicable law.
When active Studio entitlement through VIP or Master Class ends, your Studio account becomes read-only for one year. During that period you can view historical data but cannot add, edit, or remove records through the application. New critiques, submissions, assignments, and other active mentorship services are not included in read-only access. Your statutory privacy rights, including any right to request deletion, remain available through support.
At the end of that year, Studio access is removed and Studio records are deleted under the Privacy Policy, subject to limited lawful retention. Keep any permitted copies you need before access ends. If you purchase new eligible active access during the retention period, retained records may be used to restore the associated service.
6. Master Class term and Clear Plan Guarantee
Master Class lasts six months. It is not described as a subscription that can be cancelled at will for a refund. The Clear Plan Guarantee provides the following refund opportunity after you have completed 90 days in the program.
To qualify, you must have demonstrated a concerted effort to follow the program, complete assignments, and regularly submit paintings for assessment. In addition, at least one of the following must be true:
- You show no artistic growth; or
- You do not have a clear plan for how to proceed in your artistic development.
Submit a Clear Plan Guarantee refund request after your first 90 days to support@pastelworkshop.com. Include enough information for us to review your participation, assignments, painting submissions, assessments, and the reason you believe the guarantee applies. We assess the request reasonably and in good faith against these stated conditions.
If a refund is granted, it covers the full program fee paid. Any unpaid installments toward that same program fee are cancelled. Active Master Class participation and included active product access end when the approved cancellation takes effect. Studio then follows the one-year read-only rule. Included Folistry access follows the transition described in Section 7.
We do not impose an unstated request deadline or additional eligibility condition through this document. Any more detailed guarantee terms must be clearly disclosed and accepted before enrollment and cannot retroactively reduce a guarantee already purchased. Statutory cancellation, refund, and other consumer remedies remain available independently of this guarantee.
Artistic development depends on practice, participation, experience, and personal goals. Apart from the express guarantee, we do not promise a particular style, level of sales, income, award, exhibition acceptance, or professional status. This statement does not override the Clear Plan Guarantee.
7. Folistry cancellation and Master Class transition
Separately purchased Folistry subscriptions
You can cancel a paid Folistry subscription in your Folistry account settings. Cancellation stops future renewals and takes effect immediately: you lose access when cancellation is completed, even if time remains in the paid billing period. Do not assume you will retain access through the end of that period or automatically move to Folistry Free.
Folistry records are retained for up to six months after active access ends to allow reactivation. That retention is not a promise of read-only access for a cancelled standalone subscription. If access is not restored during that period, associated Folistry records are deleted and access remains unavailable, subject to the limited retention exceptions in the Privacy Policy.
Any refund of unused prepaid fees and the effective timing and consequences of a plan downgrade must be stated in the purchase terms. These Terms do not establish an unannounced no-refund rule. Required consumer refunds and other remedies are unaffected.
Folistry Premium included with Master Class
When your six-month Master Class term expires, included Folistry Premium access becomes read-only. You may choose and subscribe to Folistry Premium or another available Folistry plan, including an available Free plan, subject to its features and limits. You are not charged for a new paid plan without your authorization.
If you do not restore active access, read-only Folistry access continues for six months after the included entitlement ends. After that period, access is removed and associated Folistry records are deleted under the Privacy Policy, subject to limited lawful retention. This same six-month read-only transition applies if Master Class ends through an approved Clear Plan Guarantee cancellation.
A plan change is governed by the selected plan's limits and disclosed conversion rules. Contact support@pastelworkshop.com if you need help understanding the effect on existing records.
8. Refunds and mandatory rights
The Master Class guarantee is described above. Ordinary Skool membership and paid Folistry refund terms are those clearly disclosed before the applicable purchase. If no ordinary refund rule is stated, these Terms do not create a blanket “all sales final” restriction. Contact support@pastelworkshop.com with billing questions or requests.
Nothing in these Terms limits refunds, cancellation rights, withdrawal rights, remedies for unauthorized charges, or other protections that applicable law does not allow us to exclude. Where a country requires separate consent to begin digital content or services during a withdrawal period, that consent must be obtained through the appropriate purchase process; these Terms alone do not waive withdrawal rights.
9. Your artwork and content
“Your Content” includes artwork images, descriptions, records, submissions, messages, and other material you provide. You retain ownership of Your Content and any copyright you hold in it. Uploading artwork does not transfer that copyright to Pastel Workshop.
You grant us a nonexclusive, worldwide, royalty-free license to host, store, reproduce, resize, format, transmit, and display Your Content only as reasonably necessary to provide the Services you use, follow your sharing choices, provide critiques and support, process an AI request you choose, and maintain security and backups. We may authorize providers to perform those activities on our behalf under appropriate restrictions. This license does not authorize independent commercial exploitation or AI model training using your artwork.
The license ends when Your Content is deleted from active systems, except for limited retention and handling of backups or records retained for lawful legal, security, or dispute purposes as described in the Privacy Policy. Copies independently saved by people with whom you shared content may remain with them.
We obtain separate permission before publicly using nonpublic artwork, critiques, your name or likeness, or testimonials in promotional materials. Group participation and critique submissions alone do not grant that permission.
You must have the rights and appropriate permissions needed to provide Your Content. Owning a painting does not necessarily give you rights to distribute another person's reference photograph. Do not upload private information you have no lawful basis to provide.
10. Studio privacy and recorded coaching
Your Studio critique submissions, assignment submissions, and assessment scores are visible only to you, your mentor, and platform administrators. Your name and email address are visible to other Studio users within the platform for community and connection; they are not publicly accessible.
All coaching sessions are recorded through Zoom outside pastelworkshop.com. Recordings may include your voice, image, artwork, chat, and contributions. We provide recording notices and obtain required consent. Recordings are for authorized program participants, the mentor, and personnel or providers supporting delivery. Contact support@pastelworkshop.com before attending if you have concerns about being recorded. Attendance alone does not replace any separate consent required by law.
Respect other participants' privacy. Do not redistribute their artwork, critiques, contact details, recordings, or private discussions without permission. Do not record sessions yourself without authorization. We cannot guarantee that another participant will comply, but may act on reported violations.
11. Folistry records and portfolios
You are responsible for the accuracy of artwork, inventory, provenance, pricing, contact, and transaction information you enter. Keep appropriate independent copies of important images and business records. Folistry does not replace accounting, tax, insurance, appraisal, or legal advice, and does not guarantee artwork valuation, authenticity, ownership, or sales.
If you store information about collectors, buyers, galleries, or other people, you are responsible for the notices, permissions, and lawful use required for your activity. Do not collect unnecessary sensitive information or use records for unlawful marketing. Any applicable data processing agreement supplements these Terms for information processed on your behalf.
You control available portfolio settings: public and indexable, invite-only and not intended for indexing, or private. Check the records and fields you publish or share. Changing a setting or removing access cannot retrieve copies already independently saved or guarantee immediate removal from search engines.
12. Optional AI suggestions
Folistry Standard and Premium offer optional Gemini-powered artwork title and description suggestions. Choosing the feature authorizes processing of the selected artwork image and information needed to fulfill that request. We do not use member content for AI model training or authorize that use by the integration. Provider technical retention is addressed in the Privacy Policy.
AI suggestions can be inaccurate, generic, or similar to suggestions given to others. Review and edit results before using them, especially factual claims about an artwork. We do not guarantee that a generated title is unique, available as a trademark, copyrightable, or free of third-party claims. We do not claim ownership of your artwork because you use the feature.
13. Our instructional materials
We or our licensors own the Services, software, branding, courses, demonstration materials, exercises, videos, and original teaching materials, excluding Your Content. You receive a limited, nonexclusive, nontransferable right to use available materials for your own learning and permitted account activity during the applicable access period.
You may display and sell your own original artwork created using skills learned through our instruction. This does not grant rights in someone else's reference image or demonstration painting. Follow any specific reference or exercise license supplied with the material.
Do not resell, republish, distribute, share paid access to, or commercially teach from our protected materials without written permission, except as allowed by law. Keeping an authorized personal copy of a critique does not transfer ownership of instructor-authored teaching materials or affect your ownership of the artwork being critiqued.
14. Acceptable use and infringement reports
Do not infringe intellectual property or privacy rights; harass or threaten others; upload unlawful or malicious material; access others' accounts or records without permission; interfere with security; send spam; or evade access restrictions. Do not scrape private material or use protected service content to create training datasets without permission. These restrictions do not prohibit activities expressly protected by applicable law.
We may investigate misuse and restrict content reasonably believed to violate these Terms or the law. We do not undertake to review every submission in advance.
Report suspected copyright infringement to support@pastelworkshop.com or Pastel Workshop, PO Box 175, Harrison, AR 72601. Identify the protected work, the disputed material and its location, your contact information, and the basis of your complaint. This contact provision does not represent that a DMCA agent has been registered or that every statutory safe-harbor procedure has been established.
15. Third-party services and availability
The Services use or link to independently operated platforms, including Skool, Stripe, Zoom, video providers, and AI providers. Their separately applicable terms govern their own services. We remain responsible for our own obligations to you.
We use reasonable efforts to operate the Services, but maintenance, outages, technical problems, and events beyond our reasonable control can interrupt access. We do not promise uninterrupted or error-free availability. Legal remedies and service standards that cannot be excluded remain unaffected.
We may improve or modify features. If we materially reduce a paid service during a prepaid term, we will give appropriate notice and provide an appropriate remedy, such as substantially equivalent service or a proportionate refund for the affected unused service, where required by law or the purchase terms.
If we discontinue a paid product, we will provide reasonable advance notice where practicable, a reasonable opportunity to obtain available records where feasible, and any refunds required by law or the applicable purchase terms. Urgent legal or security issues may limit notice or access.
16. Account closure and enforcement
Contact support@pastelworkshop.com to request account closure or exercise privacy rights. Subscription cancellation and account deletion are different actions. If your request also asks to stop billing, we will treat it as a cancellation request and assist with any required platform-specific steps. A request to delete data does not itself waive a lawful fixed-term payment obligation or guarantee claim.
We may suspend or terminate access for a material violation, nonpayment, unlawful activity, or a reasonably identified security risk. Where appropriate, we provide notice and a reasonable opportunity to resolve the issue. Immediate action may be necessary to protect people, information, security, or legal compliance.
Ordinary read-only periods are described above. They do not require us to maintain access that must be restricted for a lawful security or enforcement reason, and enforcement does not eliminate required refunds or privacy rights. Product-specific retention is not a promise to keep information forever or to provide an unsupported export feature.
17. Disclaimers
To the extent permitted by law, and except for promises expressly made in these Terms or your purchase terms, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement to the extent those disclaimers are legally permitted. Educational and AI results are subject to the limitations described above.
Nothing excludes mandatory warranties, service standards, guarantees, or remedies. These disclaimers do not override the Master Class Clear Plan Guarantee.
18. Limits on liability
To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental, special, or consequential damages, or lost profits, arising from these Terms or the Services.
Subject to the exceptions below, our total liability arising from the Services is limited to the greater of US $100 or the amount you paid us for the affected Services during the 12 months before the event giving rise to the claim.
These limitations do not exclude or limit liability for fraud, intentional misconduct, gross negligence, death or personal injury where liability cannot be limited, or other liability that applicable law does not permit us to limit. They do not reduce refunds we expressly owe, including a qualifying Clear Plan Guarantee refund, or override nonwaivable consumer rights.
19. Governing law and disputes
Arkansas law governs these Terms, excluding conflict-of-law rules, except to the extent mandatory laws where you live provide protections that cannot be waived.
Please contact support@pastelworkshop.com about a concern so we can try to resolve it. This does not prevent you from making a legal claim, meeting a deadline, seeking urgent relief, or contacting a regulator.
Unless applicable law permits or requires a different forum, disputes will be heard in the Arkansas state courts located in Boone County or the federal court with jurisdiction over Boone County. These Terms do not require arbitration or waive class actions.
20. Changes and general provisions
We may update these Terms and will post the revised effective date. For material changes affecting existing accounts, we provide reasonable advance notice and obtain renewed agreement when required. Changes do not apply retroactively to an existing dispute or reduce an already purchased guarantee. If you do not accept a material change, you may stop using the Services and cancel; rights concerning prepaid service remain intact.
These Terms and the applicable purchase or program terms you accept form the agreement for the Services. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Failure to enforce a term is not a permanent waiver. You may not transfer an account or this agreement without our consent. We may transfer the agreement with the business if doing so does not unlawfully reduce your rights.
